Immigration Status as a Protected Class in Real Estate Transactions

As of January 1, 2024 the Illinois Human Rights Act includes immigration status as a protected class in real estate transactions. This means it is illegal to discriminate against someone based upon their immigration status when renting or selling property. The Act defines "immigration status" as a person's actual or perceived citizenship or immigration status. If landlords use the NAA Click n' Lease standard application program they will see the absence of questions regarding immigration status to comply with Illinois law. Non-compliance with this law may result in a civil rights and fair housing violation.
